1. Who We Are

ELATUM ("we," "us," or "our") is an AI-powered guest support platform for short-term rental hosts. ELATUM is operated by Destin L Mincy. Our service enables property hosts to deploy automated AI agents that communicate with their guests via web chat and SMS.

When we refer to the Service, we mean the ELATUM platform, dashboard, web chat interface, API, and any associated tools provided at elatum.ai and connected subdomains.

2. Information We Collect

We collect information in two primary ways: information you provide directly, and information generated automatically through use of the Service.

From Hosts (property managers and operators):

• Name, email address, and account credentials used to register and log into the dashboard
• Property information including names, addresses, check-in instructions, house rules, and any custom knowledge base content you configure
• Contact information you provide when requesting early access or onboarding

From Guests (individuals communicating with the AI agent):

• The content of messages sent to and received from the ELATUM AI agent
• Phone numbers, where guests interact via SMS (provided through the host's Twilio integration)
• A unique guest identifier generated internally to associate conversations with a session or individual
• Timestamps and channel information (web chat vs. SMS) for each message

Automatically collected technical data:

• IP addresses and general device/browser information for security and abuse prevention
• Usage metadata including response times, conversation counts, and feature interactions on the host dashboard
• Log data generated by normal server operations

3. How We Use Your Information

We use the information we collect strictly to provide, maintain, and improve the Service. Specifically:

• To operate the AI agent: Guest messages are processed to generate accurate, property-specific responses in real time
• To provide the host dashboard: Conversation history, response metrics, and property data are surfaced to authorized hosts
• To deliver SMS communications: Guest phone numbers are used solely to route messages through the host's configured Twilio number
• To improve the Service: Aggregated, anonymized usage patterns may be analyzed to improve AI accuracy and platform performance
• To communicate with hosts: We may send service-related emails, product updates, and support responses to registered host accounts
• To protect the platform: Log and technical data is used to detect abuse, prevent fraud, and maintain system security

We do not sell your data. We do not use guest conversation data for advertising purposes.

4. Data Sharing and Third Parties

We do not sell, rent, or trade personal information. We share data only in the following limited circumstances:

• Twilio: SMS messages are transmitted through Twilio's communication infrastructure. Guest phone numbers and message content are processed by Twilio in accordance with their own privacy policy. Hosts are responsible for their own Twilio account agreements.
• AI Model Providers: Guest messages may be processed by third-party AI inference providers to generate responses. No identifying guest information beyond the message content is transmitted.
• Infrastructure Providers: We use cloud hosting and database services. These providers process data on our behalf under data processing agreements and do not use your data independently.
• Legal Requirements: We may disclose information if required by law, subpoena, or other legal process, or to protect the rights, property, or safety of ELATUM, our users, or the public.

5. Data Retention

We retain conversation records and guest data for as long as the associated host account remains active, plus a reasonable period thereafter for legal and operational purposes. Hosts may request deletion of conversation data for their properties at any time by contacting info@destinlmincy.com.

Waitlist email addresses are retained until the associated host account is created or the individual requests removal.

6. Data Security

We implement industry-standard technical and organizational measures to protect your information, including encrypted data transmission (TLS), access controls, and secure credential storage. However, no system is perfectly secure, and we cannot guarantee absolute security.

In the event of a data breach that affects your personal information, we will notify affected parties as required by applicable law.

7. Guest Rights and Host Responsibility

Guests who interact with ELATUM through a host's property are doing so as guests of that property. The host is the primary data controller for guest interactions on their platform. Hosts are responsible for:

• Informing guests that AI-assisted messaging is in use
• Complying with applicable privacy laws in their jurisdiction
• Handling any guest requests to access or delete their personal data

Guests may contact the host directly or reach ELATUM at info@destinlmincy.com with privacy-related requests. We will respond within 30 days.

8. California and GDPR Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data ("right to be forgotten")
• Object to or restrict certain processing activities
• Receive a portable copy of your data
• Withdraw consent where processing is based on consent

9. Children's Privacy

The Service is not directed to individuals under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it promptly.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be communicated to registered hosts by email. Continued use of the Service after changes become effective constitutes acceptance of the updated policy.
